Sorry it took us so long. We didn't know the answer, so we posted your question to alt.visa.us. Here's the answer we got. Ingo is probably one of the best experts on the subject (although he sais he's not a lawyer):
Ingo wrote: I don't understand the question. Does he plan to abandon his plans to get an H-1B? In that case, he can indeed apply for grad school, but may have to leave the US to complete the change (I'm not sure about that). Be sure to write to INS to withdraw the H-1B. If he merely is concerned about maintaining a valid status, no need to worry. An F-1 applying for a change to H-1B is permitted to wait in the US for the approval, regardless of how long it takes (well, almost). Ingo I am not a lawyer and this is not legal advice. For reliable advice, please consult with a professional immigration attorney. For further information, check the following frequently-requested links. For many questions, you may find answers at http://travel.state.gov/visa_services.html (Department of State) or http://ins.usdoj.gov (INS).
