  can he change from illegal status to F-1

hi all.
I brother came to the USA 2 years ago with my mother on a B-2 visitor visa. The visa has long expired. Next spring he is graduating from a public high school. He is a brilliant student, in top 5%, great SAT-1 and 2, several AP classes and is doing summer research at a private university.

Other info: I am on F-1 visa and studying. My father has a green card application pending under the new LIFE act.

My bro wants to apply to good universities but is discouraged about immigration issues.

Can anyone advise me on how he can change to F-1?

Your brother really needs to see a lawyer about this. In short, if he's overstayed his tourist visa, he's here unlawfully and there's no way the INS will grant him a change of status. A lawyer might be able to help due to your father's status.
