  f1 married
av
Hello. I am an F1 student in the US
on a valid F1 visa.
If I was to get married to a permanent resident
(green card holder) in the US, would that
create any problems for either me or my
spouse? Can my spouse file for my green
card after marriage? How long does this
process take?

Thanks in advance

I have the same problem! I'm planning to go to the US next fall, and have resources for the first 2 years of college.

I have a long time relationship with a permanent resident, and we r planning to get married...well, I was thinking that 2 years would be enough to adjust status, and I was hoping to get some fin aid for the junior year.

Some threads here scared the hell out of me, I've heard about 5 YEARS WAITING?!?!?!? GEEZ, all my plans r screwed!!!

HELP US OUT!!!

P.S. for AV: yes, your spuse can file the petition for you, and you won't occur in any problems...but it seems you have to wait 5 years, plus mantain student status and not being allowed to work?!?!?!? :S

dude
5 years waiting, that's right. And no right to work.

I think it's better to wait until your partner gets citizensip. But check that marriage newsgroup, alt.visa.us.marriage-based, there's a lot of information there. I did a quick search on http://groups.google.com/ for "marriage, "green card", F-1" here's the first result:

"You can AOS based on marriage to a greencard holder. The problem is
you have to wait for your priority date before an interview is
scheduled and it could be years before that date is current.

An F-1 can stay in the US and work on optional practical training and
then get a sponsor for an H-1B. If the greencard holder becomes a USC
while awaiting their priority date, they would advise the Service
Center of citizenship and the petition would be mored to the faster
pile of I-130's based on marriage to a USC.

Rita "

Hope this helps.
