I am in the US on a F-1 visa and have just graduated.
If I use my OPT to work for the next year, then go to graduate school after it expires will I be able to get a new OPT when I finish graduate school and work for another year? Can I leave the country before I get my EAD card? When I do my masters do I get an F-1 visa or is it another one? |

Unfortunately you can only get 12 months of OPT in
total. There's an option to split it into 6 months after your first program and 6 months after the second, but you have to specify it in advance when you apply. You could get a second year of OPT if you were out of country between your programs for more then 5 months. INS doesn't allow students to leave the country before they get EAD. They would consider that you have "abandoned" the application. In practice it's possible to do it if someone would send you the EAD card over to your country, but there's a certain risk. Also it may be difficult to get a new F-1 visa if your old visa has already expired. For your masters you would extend your F-1 status - get a new (and approved) I-20 basically. You don't need to get a new visa, unless you leave the country and your old visa expires. |

Hi, I did my MS in NJIT. And as everybody does I applied for my opt . I was told to call the INS number (on their recorded information )and find out if it is approved and I can start the job .I came to know my OPT is approved om 03/12. And I immidiately started work(somehow My company did not ask for the physical card due to their requirement). And when I got the physical card the dates where 04/27 on that. And company lawyer is saying that if I go to Muliptle entry Visa or Apply for GC I will be deported as the start date of my job is 03/28 and my card approved on 04/27.I am really worried If I am out of status or how should I coorect this error. There is no physcial evidence that I heard That card is approved on 03/12. Please Advice!!! Thanks Prasad 973-698-5205 |
