I am currently in the US on an F 1 status with an I-20 because I'm going to an ESL program at a university from march to May. What happens if I decided not to go to the school on march??? The thing is that I also have the tourist visa and I'm planning to go to a college on september |

Go to ESL, because it would be problem is you don't attend your ESL class more than 80%. The director of your ESL will not sign your I-20 for transfering to the college, if your don't attend 80%. For further Questution, dogari@hanmail.net |

Here's the deal. If you enter the US using your B-2
tourist visa, you will either need to leave the US and return on your F-1 visa before you start university OR change your status from B-2 tourist to F-1 student. Changing your status takes as long as 15 months so I suggest that you don't do that. If you do go to the ESL school, you will need to study there full time until you complete the program or complete one academic session. The rules depend on your language school's policy. If you enter the US on the language school's I-20 and don't go to school, then you will be considered out of status and be in a little trouble. Good luck! |

I think your B-2 doesn't matter anymore if you are already in an F-1 status. The only thing it's good for is to come to US again as a tourist in the future - if it's a multiple-entry B-2, that is. And I don't think INS will let you change your status from B-2 to F-1 twice a year, in case you thought of reentering the country with your B-2.
If you leave your school you'll be out of status and you won't be able to transfer to college as an F-1 student. Consider taking a vacation at ESL - usually they let you do it after 6 months of study. You will also be able to be out of school for up to 60 days during your transfer to a college. If you lose your status you won't be eligible for things like OPT and you won't be able to change your status to H-1 in the future. |
